Welcome to M-Duka OS. These Terms of Service govern your use of our platform, including our website, mobile applications, and services. By accessing or using M-Duka, you agree to be bound by these terms.
Platform refers to the M-Duka OS marketplace and associated services.
Vendor refers to sellers who list products on the platform.
Buyer refers to users who purchase products through the platform.
To use certain features of the platform, you must register for an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials.
Buyers agree to provide accurate delivery information, pay for orders in full using the available payment methods, and inspect goods promptly upon delivery. Buyers must not misuse the dispute and refund process or engage in fraudulent activity of any kind.
Vendors must provide accurate product descriptions, maintain adequate inventory, fulfill orders promptly, and comply with all applicable laws and regulations — including Tanzanian standards set by the Tanzania Bureau of Standards (TBS). Vendors may not list counterfeit, stolen, prohibited, or unsafe goods. M-Duka reserves the right to suspend or remove listings and vendor accounts that violate our policies.
Delivery times shown at checkout are estimates and may vary by region across Tanzania. Risk of loss passes to the buyer upon confirmed delivery. If a delivery fails because of incorrect address details supplied by the buyer, re-delivery charges may apply.
Eligible items may be returned within the return window stated on the product page, provided they are unused and in their original packaging. Refunds are issued to the original payment method once the returned item is received and inspected by the vendor. Perishable goods, digital products, and personalised items are non-returnable unless defective.
All payments are processed through our secure payment partners, including mobile money services (M-Pesa, Airtel Money, Tigo Pesa, HaloPesa) and card payments. Funds are held in escrow until the buyer confirms receipt of goods. Commission fees are deducted according to your subscription plan. All prices are displayed in Tanzanian Shillings (TZS) unless stated otherwise and include applicable taxes where required.
The M-Duka name, logo, and platform content are the property of M-Duka OS and may not be used without written permission. Vendors retain ownership of their product images and descriptions but grant M-Duka a licence to display and promote them on the platform.
M-Duka OS is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. As a marketplace, contracts of sale are formed between buyers and vendors; M-Duka is not a party to those contracts.
These terms are governed by the laws of the United Republic of Tanzania. Disputes will first be handled through our internal resolution process; unresolved disputes may be referred to the courts of Tanzania.
We may update these terms from time to time. We will notify users of significant changes via email or platform notifications. Continued use of the platform constitutes acceptance of the revised terms.
